Introduction:

These terms of use ("Terms") govern your use of the Draw Anything AI mobile application ("App") provided by Whitemarsh Games ("Company", "we", "us", "our"). By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the App.

License:

We grant you a non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to the terms and conditions of these Terms. You may not use the App for any other purpose without our express written consent.

Content:

All content available through the App, including but not limited to text, graphics, logos, images, and software, is owned by or licensed to us and is protected by copyright, trademark, and other intellectual property laws. You may not use any content available through the App for commercial purposes without our express written consent.

Account:

You may need to create an account to use certain features of the App. You are responsible for maintaining the confidentiality of your account information and for restricting access to your device, and you agree to accept responsibility for all activities that occur under your account. We reserve the right to terminate your account at any time for any reason.

Restrictions:

You agree not to use the App for any illegal purpose or in any way that could damage, disable, overburden, or impair the App or interfere with any other party's use and enjoyment of the App. You may not:

Use any robot, spider, scraper, or other automated means to access the App for any purpose without our express written permission.
Take any action that imposes an unreasonable or disproportionately large load on the App's infrastructure.
Attempt to gain unauthorized access to the App, user accounts, or computer systems or networks connected to the App.
Use the App to transmit any viruses, worms, Trojan horses, or any other harmful or destructive code.

We reserve the right to make changes to the App or to discontinue any aspect or feature of the App at any time and without notice.

Termination:

We may terminate these Terms at any time and without notice to you. Upon termination, your license to use the App will immediately cease.

Warranty Disclaimer:

The App is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, as to the operation of the App or the information, content, materials, or products included on the App. We do not warrant that the App will be uninterrupted or error-free, and we will not be liable for any interruptions or errors.

Limitation of Liability:

In no event shall we be liable for any damages whatsoever (including, without limitation, incidental and consequential damages, lost profits, or damages resulting from lost data or business interruption) resulting from the use or inability to use the App, whether based on warranty, contract, tort, or any other legal theory, and whether or not we are advised of the possibility of such damages.

Governing Law:

These terms shall be governed by and construed in accordance with the laws of the state of Pennsylvania, without giving effect to any principles of conflicts of law.
